Recovery of Bond
Representing a leading construction company in litigation matter against a local bank before the Bahrain Chamber for Dispute Resolution (BCDR) to claim the value of a performance bond in the sum of approximately USD6-million.
Dispute with Nominee
The client is a multinational oilfield services company, which entered into a verbal nominee arrangement regarding the establishment of its Bahraini subsidiary. The nominee was to transfer all interest in the Bahraini subsidiary after establishment to our client. The nominee refused to honor his agreement claiming the ownership of the Bahraini subsidiary). Despite a distinct lack of documentation and relying on, among other things, circumstantial evidence, the court found in our client’s favor and ordered payment of damages (including for the value of the Bahraini subsidiary as well as loss of profits).
