Kuwait introduces a new regulatory framework for digital commerce.
Kuwait has approved a new Digital Commerce Law, marking a significant step toward formalising and regulating the country’s online marketplace. Digital commerce in Kuwait is entering a more structured and regulated phase.
Published in the Kuwaiti Official Gazette on 1 March 2026, the Law will enter into force one month after the publication of its Executive Regulations, which must be issued within one year of the Law’s publication.
The legislation introduces a framework governing commercial activities conducted through websites, digital platforms, applications and social media channels, with the objective of enhancing transparency, strengthening consumer protection and bringing greater structure to digital commercial practices in Kuwait’s online marketplace.
The impact is expected to be wide-ranging. Businesses operating online – including digital merchants, platform operators and social media merchants (including influencers) – should review their registration status, disclosure practices and broader compliance frameworks.
Although a transitional period has been introduced, businesses operating in the digital marketplace should begin assessing how the Law may affect their operations to minimise disruption once it becomes fully operational.
