Employment Law Implications of Regional Security Disruptions in Bahrain
Recent regional security developments have raised important legal and operational questions for employers in Bahrain. Under Bahrain Labour Law No. (36) of 2012, employers must provide a safe working environment and take necessary measures to protect employees. Salary and Attendance Obligations
Article 43 of the Labour Law provides guidance when employees are unable to perform work due to circumstances beyond their control:
- If an employee reports to work but cannot perform duties due to reasons attributable to the employer, they are entitled to full wages.
- If the disruption arises from force majeure or circumstances beyond the employer’s control, the employee is generally entitled to half wages.
- Full wages remain payable if employees can perform work remotely without interruption, or if the disruption occurs but does not affect their ability to work.
Employers must carefully assess both the cause and impact of any disruption to determine the appropriate wage obligations.
