David is a corporate commercial partner at ASAR. He joined the firm in 2005.
David has extensive experience with general corporate and commercial matters and corporate structuring considerations. David regularly advises clients on a broad range of matters including direct foreign investment, government contracting and tenders, and agency, franchise, and distributorship matters. David is also experienced with regulatory matters, particularly with respect to pharmaceuticals and medical devices, and information and communication technology.
Advising clients in relation to their setting up of a local presence in Kuwait, whether through agency/distributorship arrangements or the establishment of corporate entities including structuring advice to address Kuwait’s foreign ownership restrictions and possibilities under the Foreign Direct Investment Law.
Advising on issues relating to performance of government contracts and tenders in Kuwait, including tendering considerations, alternative corporate structuring options, tax mitigation, general contracting advice and employment related matters.
Assisting clients with regard to regulatory requirements in Kuwait, including with licensing and approvals from regulatory authorities such as the Ministry of Commerce and Industry, the Public Authority for Industry, the Ministry of Health, the Communication and Information Technology Regulatory Authority (CITRA) and the Kuwait Direct Investment Promotion Authority (KDIPA).
Advising clients on Kuwait labor law and employment law matters including terms of employment, terminations, end of service benefits, transfers of employment and pensions.
